Terms and Conditions for myTREATS TreatsFest ("Terms and Conditions")

The myTREATS TreatsFest ("Campaign") is organised by Malayan Banking Berhad (3813-K) ("Maybank") and shall be subject to these Terms and Conditions. By participating in the Campaign, the Eligible Participants (as defined in Clause 1) hereby expressly agree to be bound by the Terms and Conditions and any decisions made by Maybank with respect to the Campaign shall be final and binding.

1.0 Eligibility
a) This Campaign is open to all myTREATS customers in Malaysia ("Eligible Participants") who perform the eligible transactions (as stated in the column marked 'Type of Eligible Transactions' in Clause 2.0 b) ("Eligible Transactions") through the points redemption in myTREATS.
b) Eligible Participants may opt to pay with valid Maybank Cards or redeem their Maybank Points – TreatsPoints or Membership Rewards Points.
 

2.0 Specific Terms and Conditions Including Campaign Mechanics and Platform ("Specific Terms")
a) The Campaign duration is from 1st November 2019 at 00:00:00 to 31st December 2019 at 23:59:59 ("Campaign Period"), both dates inclusive.
b) The Campaign entitles myTREATS customers to the following complimentary gifts when the total minimum installment amount is met:

c) Each complimentary gift is valid to the first fifty(50) redemptions. There is a total of one-hundred(100) complimentary gifts for this Campaign.
d) No design/size variation selection is allowed (if any) for the complimentary gift. Complimentary gift will be given as it is on first come, first serve basis. While stocks last.
e) Complimentary gift will be delivered within 7-14 working days after Campaign has ended.
f) Complimentary gift is not eligible for orders which have been refunded, cancelled or discontinued from using Maybank 0% EzyPay Instalment Plan before the first monthly installment has been charge.
g) Complimentary gift is not refundable or exchangeable for cash or points.
h) Maybank 0% EzyPay Instalment Plan is not inclusive of administration fees, and handling fees.
i) Maybank 0% EzyPay Instalment Plan is valid for all items at myTREATS except for gift cards and vouchers category.
j) The Campaign is only accessible via the
www.maybank.com/mytreats ("Eligible Platform").
k) The Campaign is not valid in conjunction with any other ongoing promotions, offers, events or functions.
l) Maybank will not be held liable for any damages or loss arising from the late or non-delivery of the Complimentary Gift, and of data and/or complimentary points throughout the Campaign Period, save where any fault is determined as wholly attributable to Maybank. 
m) Maybank reserves the right to amend the Terms and Conditions at any time with notice.
 

3.0 Manner of Use 
a) Maybank Credit Card for the purchase of the goods and/ or services from myTREATS shall be payable to Maybank in a form of monthly instalment.
b) The term “Instalment Period” shall mean the period in which all purchases of goods and/or services purchase under Maybank 0% EzyPay Instalment Plan (“Maybank EzyPay”) at myTREATS is determined and charged to the Cardmember for payment of the Instalment.
c) The term “Monthly Instalment” shall mean the instalment amount payable to Maybank on a monthly basis during the Instalment Period.
d) The term “Due Date” shall mean twenty (20) days from the closing date of the monthly statement of account.
e) Maybank EzyPay is applicable to all new and existing myTREATS customers who are valid Maybank Cardmembers with a valid charge card which is subject to the availability of the Credit Limit at the time of purchases of goods and/or services from myTREATS.
f) The following persons are NOT eligible to purchase under Maybank EzyPay:
i.Cardmembers whose available Credit Limit is less than the Purchase Amount; and
ii. Cardmembers whose Maybank Credit Card account(s) are delinquent, suspended, cancelled, or in breach of any terms and conditions herein and/or Cardmember Agreement
g) Customer must choose the Instalment Period from a minimum of 6 months to a maximum of 12 months
h) Upon approval by Maybank, the Purchase Amount shall be considered as utilization of the Cardmember’s available Credit Limit, which shall be reduced and restored gradually following the payment of each Monthly Instalment during the Instalment Period.
i) Monthly Instalment shall be computed as the Purchase Amount divided evenly by the chosen Instalment Period. If there is a remainder, the remainder shall be added onto the first or last Instalment amount.
j) The first Monthly Instalment shall be charged to the Cardmember’s Credit Card account and reflected in the statement of account in the month following the Cardmember’s Maybank EzyPay purchase followed by the subsequent Monthly Instalments on a monthly basis until the Purchase Amount is fully repaid.
k) The Cardmember of a ‘zero interest/interest-free’ monthly repayment plan (“Maybank EzyPay”) may make (a) full payment of the monthly instalment (“Monthly Instalment”) specified by the bank at the time the Instalment Payment Plan in entered into, which is usually at the point in time of purchase, or as indicated in his monthly credit card statement, or (b) a partial payment of the Monthly Instalment.
l) The Instalment Payment Plan is free from interest only if the Cardmember settles the Monthly Instalment in full.
m) In cases where the Cardmember opts to pay the minimum amount of five percent (5%) of the balance remaining unpaid under the Instalment Payment Plan (“Outstanding Balance”) or Ringgit Malaysia Fifty (RM50), whichever is higher, instead of the Monthly Instalment in full, the Cardmember will be liable for the interest charges on the Outstanding Balance.
n) Failure to comply with paragraphs (l) and (m) will result in the Cardmember being subject to interest on the Outstanding Balance in accordance with its terms.
o) Maybank reserves the right to decline/reject any Maybank EzyPay application at its sole discretion, including but not limited to Cardmembers whose Credit Card accounts are delinquent or suspended or Authorized EzyPay Merchants who are suspected to have been operated fraudulently and/or suspended/closed by Maybank without giving any reason thereof. Maybank shall be not liable or responsible in any manner for direct, indirect, special or consequential damages arising out of any such rejection.
p) Maybank shall not be responsible for and disclaims all liability to any actions, claims, damages, costs, charges, loss and expenses which the Cardmember may suffer, sustain or incur in relation to any purchase/charge under Maybank EzyPay.
q) In the event Credit Card account is cancelled or terminated (or notice of cancellation or termination of Credit Card account has been given) by the Cardmember or Maybank for any reason; Maybank reserve the right to charge aggregate of all remaining Monthly Instalments and/or other amount payable under Terms and Conditions herein to Cardmember’s Credit Card account with immediate payment required.
r) Maybank may at any time at its sole and absolute discretion terminate the Cardmember’s Maybank EzyPay by giving a twenty one (21) calendar day’s prior written notice to Cardmembers and the aggregate of all remaining Monthly Instalments shall be due and payable immediately.
s) Notwithstanding the above, Maybank may also exercise its right under Clause 3.0 q) in the event of:
i.Credit Card account is delinquent due to default in any payment due and/or suspended by Maybank for any reason;
ii.Cardmember is in breach of any of the terms and conditions herein and/or Cardmember Agreement; and
iii.In the event of the Cardmember’s death or a bankruptcy petition is presented against the Cardmember, or the Cardmember is unable to pay his/her debts.
t) The Cardmember may at any time terminate Maybank EzyPay by giving a twenty one (21) calendar day’s prior written notice to Maybank and such termination notice shall be irrevocable.
u) Upon receipt of the termination notice by Maybank, the aggregate of all remaining Monthly Instalments shall be due and payable immediately.
 

4.0 General Terms & Conditions
a) Save where a finding of fault is wholly attributable to Maybank by a competent court, Maybank shall not be held responsible or liable for any technical failures of any kind, intervention, interruptions, and/or electronic error in the administration and/or processing of the transaction and/or prizes for the Campaign.
b) Maybank reserves the right to amend the Terms and Conditions, shorten or extend the Campaign Period, cancel, suspend, or terminate this Campaign or any part thereof within twenty one (21) days from the date the Campaign commences with notice. Such notice shall be published by Maybank via the myTREATS website (
www.maybank.com/mytreats) and/or through any other mode of communication as determined by Maybank.
c) For the avoidance of doubt, the amendment, shortening, cancellation, suspension, or termination of this Campaign by Maybank shall not entitle the Eligible Participants or any other persons whatsoever to make any claim or compensation against Maybank for any losses or damages suffered or incurred as a direct or indirect result of the such amendment, shortening, cancellation, suspension, or termination, save where a finding of fault is wholly attributable to Maybank by a competent court.
d) Maybank shall not be liable for any losses, damages, or costs incurred or suffered by any Eligible Participants as a result of the Eligible Participants participating in this Campaign, save where a finding of fault is wholly attributable to Maybank by a competent court. Furthermore, Maybank shall not be liable for any default of its obligations under the Campaign due to any force majeure event which includes but is not limited to Act of God, war, riot, lockout, industrial action, fire, flood, drought, storm, or any other event beyond the reasonable control of Maybank.
e) The Terms and Conditions shall be governed by the laws of Malaysia and all relevant parties shall hereby submit to the exclusive jurisdiction of the courts of Malaysia.
f) Maybank is entitled, based on its assessment, to, disqualify or reject any Eligible Participant who does not comply with the Terms and Conditions and/or are found or suspected to be tampering with the Campaign and/or its process or the operations of this Campaign. Tampering shall include but not limited to fraudulent activities involving any act of deceit and/or deception and/or cheating with regards to the Campaign. Maybank shall be entitled to earmark and prevent utilisation of funds from the Eligible Participant's banking accounts and also set-off the same with prior notice, where Maybank reasonably determines that an Eligible Participant has breached this clause.
